Calvert County arrest records provide comprehensive details about arrests made by law enforcement agencies within the county's limits. These records usually reveal the arrestee's identity, the reason for an arrest, the time of arrest, and other pertinent details. Arresting agencies, usually local law enforcement agencies such as the Calvert County Sheriff's Office, generate arrest records following every arrest they make. These records ensure that arrests are properly documented, thereby enabling future review by regulatory bodies and interested members of the public. Generally, public release of Calvert County arrest records is governed by the Maryland Public Information Act (PIA). Yes. Maryland Public Information Act (PIA), codified in Maryland General Provisions Article (GP), §§ 4-101 through 4-601, establishes the right of all persons to access records concerning official acts of government agencies and officials, including arrests. As a result, Calvert County arrest records are subject to public release upon request.

At the state level, record seekers may conduct background checks through the Maryland Department of Public Safety and Correctional Services (DPSCS) to find Calvert County arrest records. The results of these background checks typically reveal the search subject's arrest and prosecution information that criminal justice agencies across Maryland, including those in Calvert County, have reported to the DPSCS.

However, third parties are prohibited from conducting DPSCS's background checks on individuals without proper authorization per the Maryland Security and Privacy Act and the Code of Maryland Annotated Regulations (COMAR). Maryland residents may go to any authorized location that provides fingerprinting services to get fingerprinted on the state fingerprinting card (Form 015). Once an out-of-state applicant receives the requested fingerprint card, they may visit a local law enforcement agency or an authorized service provider in their state of residence to have their fingerprints taken.

Upon successful submission, applicants may expect a response from the DPSCS's Criminal Justice Information System within 10 to 15 days.

Interested persons may also find Calvert County arrest information through the judicial system. They may use the Maryland Judiciary Case Search portal to find information about arrests that resulted in a criminal court case. How to Find Arrest Records for Free in Calvert County

Record seekers may review the Calvert County Sheriff's News and Press Releases page to find arrest records for free. However, detailed arrest records are not accessible on the page; only limited descriptions of arrests made on specific dates are available. These descriptions may include:

  • Basic details about the arrestee, such as their full name, age, and hometown or state of residence
  • The arrest time, date, and location
  • Reason for the arrest
  • Details about what happened leading to and during the arrest
  • Charges (if applicable)
  • The arresting deputy's name

Unfortunately, users cannot search the Calvert County Sheriff's News and Press Releases page by specific criteria. Thus, they may need to review each entry for specific arrests. Additionally, older arrests (i.e., those before 2020) are not available on the page. Although information about juvenile arrests is usually published on the page, identifying information about juveniles, such as their full names, is redacted.

Interested persons may also visit the Calvert County Sheriff's Office during regular business hours to request and inspect public arrest records. Although in-person inspection of arrest records may be free, requests for physical copies may be subject to certain fees.

Alternatively, record seekers may find information about arrests that lead to a criminal case for free through the Maryland Judiciary Case Search portal. Searches on the portal may be conducted by case number or party name. They may also visit the local court that handled a case to access records in person for free.

Calvert County Arrest Report

Calvert County arrest report is an arresting officer's written account describing what happened leading up to and during an arrest. It typically contains observations made by the officer, descriptions of evidence they collected at the scene, and any witness statements.

Conversely, an arrest record only contains objective information about an arrest. They are generally free from any third-party personal observations or opinion and typically contain the arrestee's name and physical description, arrest details (date, time, and location), and the charge(s) filed.

How to Get an Arrest Record Expunged in Calvert County

In Calvert County, an arrest record may be eligible for expungement, provided certain eligibility requirements are met pursuant to MD Crim Proc Art §§ 10-101 to 10-112. An arrest that resulted in the arrestee's being released without charge (RWOC) is automatically eligible for expungement under MD Crim Proc Art §§ 10-103 to 10-103.1. In such cases, the arrestee may request expungement by completing Form ITCD-70-RWOC and submitting it to the arresting agency.

Meanwhile, arrests that resulted in an arrestee being charged with a crime, including a traffic violation, punishable by imprisonment, may be eligible for expungement if any of the following conditions are met:

  • The arrestee was found not guilty
  • The charge was dismissed
  • The charge resulted in probation before judgment (excluding charges of driving while impaired or driving while under the influence)
  • The charge was not prosecuted by the State's Attorney (i.e., Nolle Prosequi)
  • The case was indefinitely postponed (stet)
  • The case was settled
  • The arrestee was convicted of only one non-violent criminal act, and the Governor granted them a full and unconditional pardon.
  • Juvenile waived

Applicants that meet any of the aforementioned conditions may petition for expungement by completing the General Waiver and Release form (Form CC-DC-CR-078). Additionally, they may also complete the appropriate expungement petition form, depending on the specific condition their record meets. These forms include:

  • Form CC-DC-CR-072A (cases that resulted in an acquittal, dismissal, probation before judgment, Nolle Prosequi, stet, not criminally responsible verdict, or transfer to juvenile disposition)
  • Form CC-DC-CR-072B (guilty disposition for non-marijuana/cannabis related offenses)
  • Form CC-DC-CR-072C (cases that resulted in acquittal, dismissal, not guilty, Nolle Prosequi, provided less than 3 years has passed since disposition)
  • Form CC-DC-CR-072D (arrests for eligible marijuana/cannabis related offenses)

Once relevant forms have been properly completed, applicants may file them with the clerk's office of the court that handled their case (such as the Calvert County Circuit or District Court).

Note: applicants who use Form CC-DC-CR-072B or Form CC-DC-CR-072D are charged a $30 filing fee for each case. However, if they cannot afford the fee, they may request a fee waiver. Unless there is an objection or an appeal, the expungement process usually takes less than 90 days to complete.

How Do You Remove Calvert County Arrest Records From the Internet?

The official way to remove a Calvert County arrest record from the internet is by filing a petition to have the record expunged. Once an arrest record gets expunged, it's considered confidential under Maryland law. As a result, government and private entities are prohibited from publishing it online where the general public may access it.

Another way to get Calvert County arrest records removed from the internet is by submitting an opt-out request to applicable third-party aggregator websites. An opt-out request informs the receiving third-party aggregator website that an individual wishes to opt out of their services and have their record removed from the site's database.
